Les origines de la Théorie des nullités (XIIE-XIXE SI?CLE)

This thesis studies the elaboration of theoretical constructions allowing to approach the phenomenon of the invalidity of legal acts of private law in France, Germany and Italy, from the twelfth to the nineteenth century. It highlights the role of medieval jurists, who developed a coherent doctrine based on a substantial approach of the juridical act on this question, which was little thematized by Roman law. Nullity, conceived as a defect of an ontological nature, was opposed to annulment, seen as an extrinsic mechanism rendering the act ineffective, without affecting its validity. These conceptions did not exclude the recognition of techniques relativising the scope of invalidity according to the purpose pursued by the law on which it is based, that is, according to a teleological criterion. It is on these foundations, transformed as a result of developments brought about by practice, by didactic requirements, or by the general evolution of private law in the direction of voluntarism, that the theory of nullities is constituted today.
